Technical information about your device, internet connection and contact list. In addition to Photos / multimedia / archives. Operate, maintain and improve our SDK;
Answer your questions and respond to requests;
Send you reminders, technical notices, updates, security alerts, support messages and administrative;
Manage our daily business tasks, such as the administration of the SDK, analytics, compliance of our obligations determined in each of the Conditions of Use;
Comply with our legal obligations, resolve disputes and avoid inappropriate uses of the SDK;
Improve the user experience, analyzing the information we have about our users in order to understand them better, determine their interests and offer the most relevant and attractive services.

3.1 Use the communication tool

In the event that you have registered and prior acceptance of our privacy policy you give us your consent to use your personal data and the rest of the information you provide us with in order to use the different services of Shootr (specifically send messages and participate with your comments and any other information you wish to attach in any of the chats.

Remember that you have a public user profile where your photo appears, your username. This information together with your messages is public, which means, they are visible to all users of the SDK and any Internet user.

Shootr will be able to access messages for justified reasons such as:
Management of the SDK and compliance with the conditions of use of Shootr.
Legal reasons
Solve technical incidents.
Statistical analysis and product improvement.

3.2 Show advertising

If you have accepted the advertising sending clause by checking the box enabled for that purpose, it means that you consent to the processing of your personal data for sending or receiving different promotional communications:

You consent that your data can be used by Shootr for promotional communications about the products and / or services of Shootr.

You consent your data to be used for promotional communications about clients’ programming and sponsors.

You can not use Shootr if you’re under 16 years.

4. How can you exercise your rights as a user?

As a user you can: (i) require access to any personal data we have about you and request that we update, rectify or cancel, (ii) require us to refrain from using any personal information we have about you, and / or ( iii) oppose the processing of your data. 5. Close your account and log off Shootr

Any user can unsubscribe from Shootr at any time by sending an email to hello@shootr.com. In case of withdrawal (closing your account), you will lose the information and data that you could have in the specific portal or SDK, as well as the right to use any benefits or services that you could have on the date of the withdrawal.

In case you request your withdrawal, all your personal data can be kept for a specific period of time to guarantee the exercise of our processes, legal obligations and resolve possible disputes.

All your personal data will be treated and conserved to the extent strictly necessary to comply with the law or with the purposes that we have described. When your data is no longer relevant to the purposes for which it was collected, it will be deleted or anonymized, including any registration or other supporting information.

6. With whom do we share your data?

We can share some of your data with: Public orgs.

Shootr guarantees the confidentiality of personal data. However, we may disclose to the competent public authorities the data and any other information that is in our possession or that is accessible through our systems and is required in accordance with the legal provisions and regulations applicable to the case. Having an account or being a user in Shootr means that you must guarantee, both to Shootr and third parties, the quality of the information provided, that is, that the data and information provided is real, accurate, up to date and also belongs to you and not to third parties. 8. Cookies policy

Cookies used in Shootr’s SDK:
Technical: necessary to navigate the Shootr SDK correctly and to access all the sections without problems.
Analytical: allow us to understand how you browse our web, see what works and what does not, improve the website, calculate how many people use Shootr in order to improve our services. This information is anonymous and we only need it for statistical purposes.
Social media add-ons: they facilitate your access to our channels in social networks so that they can keep up with tips and news as well as participate in our online community.
Advertising: sometimes we analyze your preferences on the web to show you relevant advertising. That way we do not waste your time with offers that really do not work for you.

9. Use of plugins or social complements

11. Legislation and Jurisdiction

The user accepts that the applicable law and the Courts and Tribunals competent to hear the divergences arising from the interpretation of this clause are the Spanish, and submits, expressly waiving any other jurisdiction, to the courts and tribunals nearest to the city of Barcelona.

3. Content provided by Shootr users

The information provided in Shootr is public. The User declares to be the legitimate holder of the rights of intellectual and industrial property or to be authorized for the distribution and public communication of the contents contributed or shared in the SDK (images, opinions, etc.), and authorizes and therefore expressly cedes Shootr the content for its reproduction, distribution and public communication through any electronic means, mainly Internet, for all the world with unlimited time.

The user who decides to share and facilitate content and/or information through Shootr such as images, opinions and any other content, expressly agrees that such content may be published and indexed in Internet search engines. Likewise, Shootr reserves the right to remove content that is considered inappropriate to the characteristics and purposes of the SDK.

Shootr can not control each and every one of the published content, so it can not take responsibility for the content. In any case, the inserted and published contents are periodically reviewed to ensure the quality principles of Shootr as well as the rules indicated herein.

Any user who inserts a content that contravenes the current legislation will assume the exclusive responsibility of the damages and consequences derived from it, exempting Shootr from any responsibility.

4. Shootr user license for users

The download of Shootr is free.

Read and accept this license agreement before installing and using the SDK. If you are a natural person, you must be of legal age or have parental consent. If you acquire the SDK through a company, you must have powers to formalize this contract on behalf of the company.

Shootr grants its users a non-exclusive and non-transferable free license (hereinafter, the License) to use the SDK called Shootr.

4.1. Purpose and technical requirements

Shootr is a free SDK to share comments and content in real time on TV, OTTs and digital content platforms.

By running Shootr you accept the Shootr legal terms and conditions and execute it at your own risk.

Shootr reserves the right to update and modify the Software License and any attached reference documents.

4.2. Copyright

Shootr is the sole owner of Shootr’s trade name, copyright and distribution rights. Copyrights include the appearance and style of the Shootr software. This contract is a license to use Shootr and does not imply a transfer of ownership of the rights of a program.

The user can not change, deconstruct, disassemble or decompile Shootr. Which includes the use of any current or future technology.

Failure to comply with any of the terms and conditions of this License will be construed as a breach of the Terms of Use.

4.3. Guarantees and responsibilities

You must use Shootr in accordance with the terms and conditions of this document. Shootr will not be liable for damages arising from the use of Shootr in a manner contrary to this License.

Except for the responsibilities established in the consumer protection regulations, the user exonerates Shootr from any liability arising from the improper execution of the SDK or the improper functioning thereof caused by the way in which the software was executed. This exoneration of responsibility extends to the employees and management of Shootr.

Shootr expresses that this License to use Shootr does not violate any previous contract or current legislation.

Shootr does not guarantee the availability, continuity or fault-free operation of the SDK. Therefore, to the extent permitted by law, this warranty does not include damages arising from the lack of availability or operation of Shootr and any services provided by the SDK.

Shootr does not assume responsibility arising from unforeseeable circumstances or force majeure. Also, Shootr will not be responsible for any cause beyond reasonable control, such as the existence or entry of viruses and interference from third parties.

5. Exclusion of guarantees and liability

Shootr reserves the right to cancel access to the SDK, as well as all or part of the content provided through it, at any time and without notice, for technical reasons, security, maintenance or power failures or any other reasonable cause.

Consequently, Shootr does not guarantee the reliability, availability or continuity of the SDK or the content, so the use is done at your own risk and Shootr can not be held responsible for the discontinuity or unavailability of these services.

Shootr is not responsible for any interruption of the SDK, delays, errors, malfunctions and, in general, any other problem arising from causes beyond the reasonable control of Shootr, and/or due to willful misconduct or the fault of the users, and/or due to causes of force majeure. Force Majeure means all those events beyond the reasonable control of Shootr, such as; failures of third parties, operators or service companies, acts of government, lack of access to third party networks, acts or omissions of public authorities, or those produced as a result of natural disasters, blackouts, hacker attacks or other third parties to the security or integrity of the system. In any case, whatever the cause, Shootr will not have any responsibility for direct or indirect damages or for losses incurred.

SHOOTR disclaims any liability for damages of any kind that may result from the lack of truthfulness, accuracy, completeness and/or punctuality of the content transmitted, stored, made available or received, obtained or accessed through the SDK, for the content provided by third parties.

SHOOTR will use reasonable commercial efforts to update and correct information stored in the SDK that does not meet minimum standards of accuracy.

SHOOTR is not responsible for the content of the information collected in the SDK, nor for the opinions, comments or other communications that are not issued directly by Shootr.

Shootr excludes all liability for damages of any kind that may result from the presence of viruses or the presence of other harmful elements in the content that may cause alterations in the computer systems, as well as in documents or other systems stored in the SDK .

Shootr excludes all responsibility for the content that users publish in Shootr through the SDK or any other means, therefore, users are responsible for the content sent by them.

Likewise, SHOOTR is not responsible for the use that users make of the content of the SDK or its passwords and any other material contained in the SDK that potentially constitutes a violation of intellectual property rights or other rights of third parties. Also, Shootr is not responsible for possible security errors that may occur through the use of outdated versions of browsers or software of smartphones, or the consequences that may arise from malfunctioning browsers, either by incorrect configuration, computer viruses or any other cause not directly related to SHOOTR.

6. Applicable legislation and competent jurisdiction

SDK Shootr, excluding links to third parties, is controlled by Shootr Network, S.L.U. By accessing and / or using Shootr the user expressly accepts that all disputes, claims and other issues arising or related will be governed by current Spanish regulations and any dispute will be submitted to the Courts and Tribunals of the city of Barcelona, ​​unless The regulations for the protection of consumers and users establish another criterion.
